Preamble
These Terms and Conditions of Use (TCU) for gift cards apply exclusively to gift cards offered by Les Jardins de Gaïa, whose registered office is located at 6 rue de l'Ecluse – 67820 WITTISHEIM, registered with the Colmar Trade and Companies Register under number 398 560 375 (hereinafter "Les Jardins de Gaïa"), and any natural person acting as a consumer (hereinafter the "Customer").
Any order for a gift card on the website www.jardinsdegaia.com implies unreserved acceptance of these Terms of Use.
Les Jardins de Gaïa reserves the right to modify these Terms of Use at any time. The applicable Terms of Use are those in force on the date of the order.
Article 1 – Use and validity of gift cards
Gift cards are valid only on the Les Jardins de Gaïa online store (www.jardinsdegaia.com) and can be used to pay for all or part of an order.
- Each gift card contains apersonalizedcode.
- The code is valid for 12 months from the date of purchase.
- If not used before the expiry date, the code becomes invalid, with no possibility of refund or extension.
- The code must be entered in the space provided when confirming your basket.
- Only one code can be used per order.
- If the full amount of the card is not used during an order, the remaining balance is automatically re-credited in the form of a new code, sent by email and visible in the Customer's personal account, under the "Discount vouchers" section.
- The Customer can check the balance of their gift card at any time in their personal account, under the "Discount vouchers" section.
- Gift cards are non-exchangeable and non-refundable, even partially, and cannot be exchanged for cash or monetary compensation.
- The use of the gift card does not cover shipping costs.
Article 2 – Ordering and delivery terms
The gift card is ordered via the Les Jardins de Gaïa website.
a) Ordering process
The Customer chooses the amount of the gift card from among the values offered, fills in the requested information (in particular the recipient's email address and any personalized message), then proceeds to online payment.
b) Receipt
Once the order has been placed and payment has been confirmed, the Customer or the recipient (if the latter's details have been provided) will automatically receive an email containing a ready-to-use PDF with the gift card code.
No physical gift card will be sent.
It is the Customer's responsibility to check the accuracy of the information provided (particularly the email address). Les Jardins de Gaïa cannot be held responsible for non-receipt due to an error in entering the email address.
Article 3 – Price, payment, and billing
Gift cards are available in several fixed amounts (€20, €30, €35, €40, €50, €60, €100, and €150), including all taxes.
Payment is made exclusively online, by credit/debit card via the secure methods offered on the website.
No other payment methods (bank transfer, check, cash, etc.) are accepted.
Once payment has been confirmed, no refunds or order changes can be requested.
Article 4 – Gift cards in a basket with other products
Gift cards are considered dematerialized products.
Therefore, when a Customer purchases a gift card in addition to physical products, the amount of the card is not included in the total basket amount for the calculation of free shipping.
Example: An order including a gift card (€100) and two bags of tea (€15) will be subject to shipping costs applicable to the €15 worth of physical merchandise.
Article 5 – Right of withdrawal
When purchasing a gift card on the Website, the Customer has a right of withdrawal in accordance with Article L. 221-18 of the French Consumer Code.
The Customer has a period of 14 (fourteen) days from the date of purchase of the gift card to exercise their right of withdrawal.
To this end, a characterful withdrawal form is available to the Customer by clicking on the following link (Model withdrawal form), in accordance with Article L221-5 of the French Consumer Code.
The Customer will be refunded for their purchase by Les Jardins de Gaïa within a maximum of 14 days following the date on which this right was exercised, using the same means of payment as that used by the Customer for the initial transaction, unless the purchaser wishes otherwise.
The Customer is informed and acknowledges that they will lose their right of withdrawal if they use all or part of the gift card before the end of the withdrawal period.

Article 7 – Liability
Les Jardins de Gaïa cannot be held liable in the event of loss, theft, fraudulent use of the code, or any malfunction related to use beyond their control (e.g., hacking of the Customer's account, email error, etc.).
Article 8 – Personal data
The information collected when ordering the gift card is necessary for processing the order. It is processed in accordance with Les Jardins de Gaïa's privacy policy.
Article 9 – Language
These Terms of Use are written in French. In the event that they are translated into one or more languages, only the French text shall be deemed authentic in the event of a dispute.
Article 10 – Dispute resolution
For any complaint or dispute relating to the purchase or use of a gift card, the Customer is invited to contact Les Jardins de Gaïa customer service in the first instance in order to seek an amicable solution.
